Terms of service
These Terms of Service (“Terms”) govern your access to and use of toromi.ca (the “Site”) and any purchases, orders, or services provided by Toromi (“Toromi,” “we,” “us,” “our”). By using the Site or placing an order, you agree to be bound by these Terms.
If you do not agree, do not use the Site or place an order.

1) Eligibility
You must be at least the age of majority in your jurisdiction to place an order. By ordering, you represent that you have the legal capacity to enter into a binding agreement.

2) Pickup-Only Service
Toromi is pickup only. We do not ship.
Pickup instructions (including location and time window) will be provided at checkout or in your order confirmation.
Late pickup / no-show
You are responsible for picking up your order at the scheduled date/time. Quality of perishable items may be affected by delays. No refunds are provided for late pickup or no-show (see Section 7).

3) Product Information
We attempt to display products, sizes, designs, and colors accurately. However:
Photos are for reference and final appearance may vary, especially for handmade/custom items.
Seasonal availability, ingredients, and decorations may change without notice.

4) Custom Orders and Messages
If you request customization (e.g., name, message, design notes), you are responsible for providing accurate instructions. Toromi may refuse any customization request that is unlawful, hateful, harassing, infringing, or otherwise inappropriate.

5) Pricing, Taxes, and Payment
All prices are shown in the currency displayed on the Site and may be changed at any time. Taxes (and any applicable fees) are calculated at checkout.
Payment must be completed before an order is confirmed. We may use third-party payment processors; your payment may be subject to their terms in addition to these Terms.

6) Order Acceptance and Right to Refuse
Your order is an offer to purchase. We may accept, decline, or cancel an order at our discretion (including for suspected fraud, errors, or supply constraints). If we cancel an order before pickup, we will provide an appropriate remedy consistent with applicable law.

7) All Sales Final: No Returns, No Refunds
All sales are final. Due to the perishable nature of our products and for food-safety reasons:
No returns
No refunds
No exchanges
No store credit
This applies to all items, including made-to-order and custom products, and any discounted/promotional purchases.
Exception (at pickup only): If there is a problem attributable to Toromi (e.g., wrong item, visible defect/damage) it must be addressed at the time of pickup before you leave (see Section 8). Nothing in these Terms limits your rights under applicable law.

8) Mandatory Inspection at Pickup (Check Before You Leave)
You (or your designated pickup person) must inspect your order before leaving the pickup location. Please confirm:
Correct item(s) and quantity
Correct message/writing (if applicable)
Visible defects or damage (e.g., cracked cake, broken decorations, crushed packaging)
If there is an issue, you must notify us immediately at pickup. We will assess the issue on the spot and, where appropriate, provide a resolution at our discretion (for example, correction, repair, or replacement if feasible and available).
Once you leave with the order, the order is deemed accepted “as-is,” and no claims will be processed afterward, except where required by applicable law.

9) Handling, Transport, and Storage After Pickup
Once the order is handed over at pickup, you are responsible for:
Safe transport (keeping items level and secure)
Avoiding heat/sun exposure and not leaving items in a vehicle
Proper refrigeration/storage and serving conditions
Toromi is not responsible for damage or quality issues that occur after pickup due to handling, transport, storage, or environmental conditions.

10) Allergens and Dietary Information
Our kitchen may handle common allergens, including (but not limited to) milk, eggs, wheat/gluten, soy, peanuts, and tree nuts. We cannot guarantee an allergen-free environment or prevent cross-contact.
You are responsible for confirming ingredients and suitability before ordering. Toromi does not provide medical advice.

11) Promotions and Gift Cards
Promotions are subject to additional terms and may be modified or ended at any time. Gift cards (if offered) are non-refundable and may have additional terms.

12) Intellectual Property
All content on the Site—logos, product names, images, designs, text, and other materials—is owned by Toromi or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or exploit Site content without written permission.

13) Prohibited Use
You agree not to:
Use the Site for unlawful purposes
Attempt to gain unauthorized access to the Site or systems
Interfere with Site operations or security
Submit false information, impersonate others, or engage in fraud
Infringe intellectual property or privacy rights

14) Third-Party Services and Links
The Site may rely on third-party platforms or services (e.g., payment processors). We are not responsible for third-party services and they may have their own terms and privacy policies.

15) Disclaimer of Warranties
To the fullest extent permitted by law, the Site and all products/services are provided “as is” and “as available.” We do not guarantee that the Site will be uninterrupted or error-free.

16) Limitation of Liability
To the fullest extent permitted by law, Toromi will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or loss of data, arising from or related to the Site or products.
To the fullest extent permitted by law, Toromi’s total liability for any claim will not exceed the amount you paid for the specific order giving rise to the claim.

17) Indemnity
You agree to indemnify and hold Toromi harmless from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site, violation of these Terms, or infringement of any rights of a third party.

18) Privacy
Your use of the Site is also subject to our Privacy Policy (if posted). If there is a conflict between these Terms and the Privacy Policy, these Terms govern regarding use/purchases, and the Privacy Policy governs regarding data handling.

19) Changes to These Terms
We may update these Terms from time to time by posting an updated version on the Site and revising the “Last updated” date. Your continued use of the Site after changes means you accept the updated Terms.

20) Governing Law and Venue
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-laws rules. You agree that any dispute will be brought in the courts located in Toronto, Ontario, unless applicable law requires otherwise.

21) Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
